1. Terms

By accessing this service, you are agreeing to be bound by these terms of use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this service. The materials contained in the QWZ app and associated website(s) are protected by applicable copyright and trademark law.

2. Use License

a. Permission is granted to temporarily download one copy of the materials (information or software) for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• attempt to decompile or reverse engineer any software contained in the QWZ app;

• remove any copyright or other proprietary notations from the materials; or

• transfer the materials to another person or "mirror" the materials on any other server.

b. This license shall automatically terminate if you violate any of these restrictions and may be terminated by QWZ at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

c. You are responsible for your use of the App and Service, and for any use of the App or Service made using your account. When you use the App or Service, you may not:

• Violate any law or regulation;

• Violate, infringe, or misappropriate other people's intellectual property, privacy, publicity, or other third party legal rights;

• Upload, communicate, transmit or otherwise make available in the App or in any other Service, any content that is, or could reasonably be, viewed as unlawful, harmful, harassing, defamatory or otherwise objectionable, of pornographic, obscene or indecent nature, invasive of another's privacy, hateful, likely to incite violence or racial or ethnic hatred, or any other content that could be prejudicial to your own rights or to those of third parties;

• Send unsolicited or unauthorized advertising or commercial communications, such as spam, forge any TCP/IP packet header or the IP address or any part of the header information in any email or posting, or in any way use the Service to send altered, deceptive or false source-identifying information;

• Participate in the use of software, including but not limited to spyware, designed to collect data from the App or Service;

• Collect information and/or personal data of other users

• Interfere with or disrupt the proper provision of the Service, user access, or the servers or networks that provide the Service, or transmit any viruses or other computer instructions or technological means whose purpose is to disrupt, damage, or interfere with the use of computers or related systems; stalk, harass, or harm another individual;

• Impersonate any individual or legal entity

• Attempt to circumvent any technological measure or authentication measures implemented by us or any of our providers or any other third party (including another user) to protect the App or our Service;

• Access, search or attempt to access or search the Service by any means (automated or otherwise) other than through the interfaces published by us;

• Use the Services in any other way not permitted by these Terms; or

• Advocate, encourage, or assist any third party in doing any of the foregoing

3. Ownership of Content

Please be informed that we are the rightful owners or have license of all rights regarding the App and Service, including all software, text, media, trademarks, logos, brand elements, and any other Content available on the App and Service.

4. Advertising Content

The App and Service may include advertisements and other information, which may be targeted due to the content or information on the Service.

You accept that, in consideration of the use of the App and Service, QWZ and/or other third parties associated with it may include and distribute advertising material, both its own and belonging to third parties, at any time on the App and Service.

5. Disclaimer

a. The materials in the QWZ app and associated website(s) are provided on an 'as is' basis. QWZ makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

b. Further, QWZ does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials in the QWZ app or otherwise relating to such materials or on any sites linked to the QWZ app and associated website(s).

6. Limitations

In no event shall QWZ or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials in the QWZ app or associated website(s), even if QWZ or an authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

7. Accuracy of materials

The materials appearing in the QWZ app and associated website(s) could include technical, typographical, or photographic errors. QWZ does not warrant that any of the materials in the QWZ app or associated website(s) are accurate, complete or current. QWZ may make changes to the materials contained in the QWZ app and associated website(s) at any time without notice. However QWZ does not make any commitment to update the materials.

8. Links

QWZ has not reviewed all of the sites linked to the QWZ app and associated website(s) and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by QWZ. Use of any such linked website is at the user's own risk.

9. Modifications

QWZ is entitled to change these Terms of Service at any time in its sole discretion by providing an updated copy of these Terms of Service on the QWZ app and associated website(s). For the avoidance of doubt, your use of QWZ following any update or modification to these Terms of Service shall be deemed as acceptance of any such updated Terms of Service. QWZ reserves its right to transfer its rights and obligations under these Terms of Service to a third party.

Each of the Terms of Service listed and outlined above operate separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses will remain in full force and effect.

10. Subscriptions

QWZ offers a premium subscription for full access to all question packs, features, and functionality.

• Subscription is auto-renewable which means that once purchased, it will be automatically renewed monthly until you cancel it 24 hours prior to the end of the current period.

• Your iTunes Account will be charged for renewal within 24-hours prior to the end of the current period.

• Manage your Subscription and Auto-Renewal by going to your Account Settings after purchase.

11. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Delaware and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
